This matter is before the court on defendants-appellees petition for rehearing with suggestion for rehearing en banc. Defendants-appellees contend that in its opinion issued July 5, 2005, the panel confused the concept of "real party in interest" under Federal Rule of Civil Procedure 17 with the concept of "real party to the controversy" discussed in Navarro Savings Association v. Lee , 446 U.S. 458 (1980). Upon consideration, the panel concludes that it did not confuse the two doctrines and it DENIES the petition for panel rehearing. Nonetheless, the panel will clarify the rationale in its opinion by issuing an amended opinion. Accordingly, the panel WITHDRAWS the opinion issued July 5, 2005, and substitutes a modified opinion filed this date. A copy of the amended opinion is attached to this order.
